1About these terms
These terms are the agreement between you and BARBELLBITES LTD (“BarbellBites”, “we”, “us”), a company registered in England and Wales (company number 17042421), registered office 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom.
They cover the BarbellBites app: the website at barbellbitesapp.com and our iPhone and Android apps (together, “the app”). Our shop at barbellbites.com has its own terms. Our Privacy Policy explains how we use your information.
By creating an account or using the app, you agree to these terms. Please read them carefully. If you live in the UK, you have legal rights as a consumer, and nothing in these terms takes those away.
2Who can use BarbellBites
- You must be at least 16 years old.
- If you’re under 18, you need a parent or guardian’s permission to buy Premium.
- The app is for your own personal use, not for business or commercial use.
- You can only have one account, and you must not use the app if we’ve closed your account before for breaking these terms.
3Your account
- You can sign up with your email address, or with Apple or Google. Give us accurate details and keep them up to date.
- Keep your password private and don’t let anyone else use your account. Tell us straight away at [email protected] if you think someone else has got into it.
- Your username must not pretend to be someone else (including BarbellBites), be offensive, or use someone else’s brand. We may ask you to change a username that breaks these rules, or change it for you.
6Cancelling and refunds
6.1 How to cancel
- Website, or an Android subscription paid by card: go to Settings > Manage Subscription. We may show you an offer before you finish, but you can always skip it and cancel.
- Android app (Google Play): in Google Play, tap your profile picture, then Payments and subscriptions > Subscriptions. Settings > Manage Subscription in the app takes you there too. Deleting the app doesn’t cancel a Google Play subscription, but deleting your BarbellBites account does.
- iPhone app (App Store): go to your iPhone’s Settings > your name > Subscriptions. Deleting the app or your BarbellBites account doesn’t cancel an App Store subscription.
When you cancel, your subscription won’t renew. You keep Premium until the end of the period you’ve already paid for, then your account goes back to the free app. Your logs and progress stay.
6.2 Your 14-day right to cancel
If you subscribe on our website or in the Android app, you have 14 days to change your mind. If you start with a free trial, those 14 days are your trial: cancel before it ends and you won’t pay anything. If you subscribe without a free trial, email [email protected] within 14 days of your first payment and we’ll refund it in full. For a Google Play subscription, the refund goes back through Google Play.
6.3 Other refunds
- Apart from that, payments aren’t refundable, including for time left in a period when you cancel. You keep Premium until the period ends.
- Apple handles payments and refunds for App Store purchases. You can ask Apple for a refund at reportaproblem.apple.com.
- Google handles payments for Google Play purchases, and Google Play’s refund policies also apply. You can ask Google for a refund in Google Play, or ask us.
- None of this affects your legal rights if Premium is faulty or not as described. If something isn’t working, tell us and we’ll put it right.
7Points and virtual items
You earn points for using the app, such as logging workouts and meals, and you can spend them in the shop on profile items like borders, badges and banners. Points and items have no cash value. They can’t be bought, sold, swapped for money or moved to another account, and they’re lost if your account is deleted. We may change how points and the shop work, and remove points earned by cheating.
8Health and safety
BarbellBites is a fitness and nutrition tracker. It isn’t a medical service and doesn’t give medical advice, diagnosis or treatment.
- Talk to a doctor before starting a new diet or training programme, especially if you’re pregnant or breastfeeding, have a medical condition, take medication, are recovering from an injury, or are under 18.
- If you have, or have had, an eating disorder, tracking calories and macros may not be right for you. Please speak to your GP first. Beat, the UK’s eating disorder charity, can help: beateatingdisorders.org.uk.
- Training carries a risk of injury. Warm up, use good technique, choose weights you can control, and stop if you feel pain, dizziness or chest pain or struggle to breathe.
- You’re responsible for your own decisions about what you eat and how you train.
9Food data, plans and the coach
- Food information comes from our own food library, what users enter, and these sources:
- Branded products: Open Food Facts, a public database anyone can add to, available under the Open Database Licence.
- Everyday UK foods: McCance and Widdowson's The Composition of Foods Integrated Dataset 2021 (Public Health England). Contains public sector information licensed under the Open Government Licence v3.0.
- Everyday US foods: the USDA National Nutrient Database for Standard Reference (public domain).
- Allergies and intolerances: our filters help you find suitable meals, but they rely on that same information and can’t guarantee a food is safe for you. Always check ingredients and labels yourself.
- The coach, the TDEE calculator, meal plans and programmes give estimates and general guidance based on what you log. They work best when your logs are accurate, they aren’t a substitute for professional advice and they won’t suit everyone.
- Meal photo estimates are a rough guide worked out from a picture. They can be out, especially for portion sizes and things the photo can’t show, like oil or sauce, so check and adjust them before you log. There’s a daily limit on photos, shown in the app.
10Community rules
BarbellBites should be a supportive place for everyone. These rules cover everything other people can see, including your username, name, profile photo, group and challenge names, and your activity. You must not:
- share anything illegal, including content that sexually exploits or abuses children, terrorist content, threats, or content that encourages violence;
- bully, harass, threaten or intimidate anyone;
- post hateful content about people because of their race, religion, sex, sexual orientation, disability or gender identity;
- share sexual or explicit images;
- encourage self-harm, suicide or eating disorders, or promote extreme or dangerous dieting;
- pretend to be someone else, including BarbellBites;
- share other people’s personal information or photos without their permission;
- spam, advertise or sell things to other users;
- fake workouts, steps or logs to climb leaderboards, win challenges or earn points;
- create fake or multiple accounts;
- hack, overload, scrape, copy or reverse engineer the app, or use bots or other automated tools on it.
If you break these rules, we may remove content, reset points or progress, or suspend or close your account (see sections 11 and 17).
11Reporting, safety and complaints
11.1 How we protect you from illegal content
- When we find out about illegal content, we remove it quickly and act against the account responsible, which can mean closing it.
- We review reports as soon as we can, normally within 2 working days, and deal with the most serious first, such as threats to someone’s safety or content that exploits children.
- Where the law requires, we report content to the police or other authorities, for example child sexual abuse material to the National Crime Agency.
11.2 How to report someone or something
- Tap Report User in the menu next to a friend, or email [email protected] with “Report” in the subject. Tell us the username, what happened and where you saw it, and add screenshots if you can.
- You can block someone at any time. Blocking removes them from your friends and stops them finding you or sending you friend requests.
- If you think someone is in immediate danger, call 999.
11.3 Complaints and appeals
- You can complain to us about content on the app, how we handled a report, action we took against your content or account, or how we’re meeting our online safety duties. Email [email protected].
- If we remove your content or restrict your account, we’ll tell you why, unless the law or someone’s safety stops us. You can appeal by emailing us. We’ll look at it again, normally within 14 days, and put things back if we got it wrong.
- You also have the right to take legal action if you think we’ve broken these terms.
12Your content
Everything you add to the app, such as your logs, photos, recipes and profile, stays yours. So that we can run the app, you give us permission to store it, back it up, process it and show it to you and to the people you choose to share it with. That permission is free, worldwide and only for running and improving the app. It ends when you delete the content or your account, apart from copies we must keep by law.
You’re responsible for what you add, and you must have the right to share it. If you send us ideas or feedback, we may use them without paying you or owing you anything.
13Our content and brand
The app and everything in it that isn’t your content, including its design, code, logos, the BarbellBites name, programmes, meal plans, recipes and text, belongs to us or the people who license it to us. You may use it for your own personal, non-commercial use through the app. You must not copy, sell, share or republish it, or build a competing product from it.
14Apple and Google
14.1 If you got the app from the Apple App Store
- These terms are between you and BarbellBites, not Apple. We, not Apple, are responsible for the app and its content.
- You can use the iPhone app on Apple devices that you own or control, as allowed by the App Store’s Usage Rules.
- Apple has no duty to provide any maintenance or support for the app.
- If the app doesn’t meet a warranty that applies to it, you can tell Apple and Apple will refund the price you paid for the app (if any). Beyond that, and as far as the law allows, Apple has no other warranty obligation for the app.
- Apple isn’t responsible for dealing with claims about the app, including product liability claims, claims that the app breaks a law or regulation, and claims under consumer protection or similar laws. Apple isn’t responsible for investigating, defending or settling claims that the app infringes someone’s intellectual property.
- You confirm that you’re not in a country under a US Government embargo, or that the US Government has labelled as “terrorist supporting”, and that you’re not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple has the right to enforce them against you.
14.2 If you got the app from Google Play
Google Play’s terms also apply to downloading the Android app.
Send any questions, complaints or claims about the app to us, using the details in section 22.
15Other services we connect to
The app works with services run by other companies, such as Apple Health, Health Connect, Sign in with Apple and Google, Stripe, Google Play and Open Food Facts, and it links to other websites. Their own terms and privacy policies apply when you use them. We aren’t responsible for those services, but we choose them carefully.
16Changes to the app
- We keep improving BarbellBites, so features will change. We try to keep the app running smoothly, but it may sometimes be unavailable, for example for maintenance or because of problems outside our control.
- If we make a change that significantly reduces what Premium offers, we’ll tell you in advance. You can then cancel, and we’ll refund any time you’ve paid for but won’t be able to use.
- If we ever stop running the app, we’ll give you at least 30 days’ notice where we can, help you get a copy of your data, and refund any Premium time you’ve paid for but can’t use.
17Ending your account
- You can delete your account at any time in Settings > Delete Account. Our Privacy Policy explains what happens to your data.
- We may suspend or close your account if you seriously or repeatedly break these terms, use the app illegally, put other people at risk, commit fraud, or if the law requires us to. Where we can, we’ll warn you first and tell you why, and you can appeal (section 11.3).
- If we close your account and it wasn’t because you broke these terms, we’ll refund any Premium time you’ve paid for but won’t be able to use.
18Our responsibility to you
- If we break these terms or don’t use reasonable care and skill, we’re responsible for loss or damage you suffer that was a foreseeable result. Loss is foreseeable if it was obvious it would happen, or if both of us knew it might happen when you started using the app.
- We don’t exclude or limit our responsibility where the law doesn’t allow it. That includes death or personal injury caused by our negligence, fraud, and your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 if Premium is faulty or not as described.
- If digital content we supply damages your device or other digital content because we didn’t use reasonable care and skill, we’ll either repair the damage or pay you compensation.
- The app is for personal use, so we’re not responsible for business losses such as lost profits or lost business opportunities.
- We’re not responsible for delays or failures caused by events outside our reasonable control, but we’ll tell you and do what we can to limit the effect.
- Apart from the things above that we can’t limit, our total responsibility to you is limited to the greater of £100 or the amount you paid us for Premium in the 12 months before the problem happened.
19Changes to these terms
We may update these terms, for example when the law or the app changes. If we make an important change, we’ll tell you at least 30 days before it applies, by email or in the app. If you don’t agree with it, you can cancel Premium before the change applies and stop using the app. If you keep using the app after that, the new terms apply. The date at the top shows when these terms last changed.
20Law and disputes
- If you have a problem, please contact us first at [email protected]. Most things can be sorted out quickly.
- These terms are governed by the law of England and Wales, and you can bring legal proceedings in the courts of England and Wales. If you live in Scotland or Northern Ireland, you can also bring proceedings in your local courts, and your local law still protects you.
- If you live in the EU, you also keep the protection of the consumer law where you live.
- If we can’t resolve a complaint, we’ll tell you about an alternative dispute resolution service and whether we’re willing to use it.
21General
- We may transfer our rights and duties under these terms to another organisation, for example if BarbellBites is sold. We’ll tell you, and it won’t reduce your rights. You can’t transfer your account to anyone else.
- If a court decides part of these terms can’t be enforced, the rest still applies.
- If we don’t enforce a right straight away, we can still enforce it later.
- Nobody else has rights under these terms, apart from Apple as set out in section 14.1. Any terms you’re shown when you buy Premium also form part of our agreement.
